These Terms and Conditions govern your use of the website theroyalaesthetics.com and the consultation and treatment services offered by The Royal Aesthetics. Please read them carefully. By using this website or requesting an appointment, you accept these terms.

• Website — theroyalaesthetics.com and all of its subpages.
• User or you — any person who accesses the Website.
• Patient — any person who receives a consultation or treatment from us.
• Services — the aesthetic medical, surgical and non-surgical services we provide.
• Consumer — a natural person acting for purposes outside their trade, business or profession, within the meaning of Romanian consumer protection legislation.

3. Acceptance and changes

Using the Website means you accept these terms in the version published at the time of your visit. We may amend them to reflect changes in our services or in the law; the revised version takes effect when published, and the date at the top of this page shows when that happened. Terms accepted at the time you booked continue to apply to that booking.

4. Use of the Website

You may browse the Website and use its forms for lawful, personal purposes. You agree not to:

• use the Website in a way that damages, overloads or impairs it, or interferes with anyone else’s use of it;
• attempt to gain unauthorised access to any part of the Website, its server or connected systems;
• copy, scrape, republish or commercially exploit our content without written permission;
• submit false, misleading or third-party personal data through our forms;
• upload anything unlawful, defamatory, obscene or infringing.

We may suspend or restrict access to the Website for anyone who breaches these terms.

5. Information on the Website is not medical advice

The descriptions of procedures, indications, recovery times and results published on the Website are general information for the public. They are not medical advice, they do not constitute a diagnosis or a treatment recommendation, and they do not create a doctor–patient relationship. Only a qualified physician who has examined you in person can advise on whether a procedure is appropriate for you. Please read our Medical Disclaimer in full.

6. Enquiries, consultations and appointments

6.1 Requesting an appointment

Submitting a form or messaging us is a request, not a confirmed booking. A booking exists only once we have confirmed a specific date and time to you in writing.

6.2 Information you must provide

You must give accurate and complete information about your medical history, medication, allergies, previous procedures and any condition that could affect your treatment. Withholding or misstating such information may make a procedure unsafe, and may lead us to postpone or decline treatment.

6.3 Consultation

Every treatment is preceded by a consultation with a qualified physician, who will assess your suitability, explain the procedure, the alternatives, the expected outcome and the risks, and answer your questions. We reserve the right to decline treatment where, in our clinical judgement, it is not in your interest or not medically appropriate.

6.4 Informed consent

No procedure is carried out without your written informed consent, obtained in accordance with Romanian healthcare legislation. You may withdraw your consent at any time before the procedure begins.

6.5 Age

Our Services are intended for adults. Where treatment of a minor is lawful and clinically justified, it requires the documented consent of a parent or legal guardian.

7. Prices, deposits and payment

Prices communicated on the Website or in marketing material are indicative and given for guidance only. The price applicable to you is the one quoted in writing after your consultation, based on your individual treatment plan. Quotations are valid for the period stated in them.

We may require a deposit to secure an appointment or a surgical date. Unless stated otherwise in your quotation, the deposit is applied against the final price. Payment terms, accepted methods and any instalment arrangements are set out in your quotation or treatment agreement.

8. Cancellations, rescheduling and no-shows

• Please tell us as early as possible if you need to cancel or move an appointment. We ask for at least 48 hours’ notice for consultations and non-surgical treatments, and at least 14 days’ notice for surgical procedures, so that the slot can be offered to another patient.
• Where notice is given within those periods, we will reschedule you without charge, and any deposit is carried over to the new date.
• Where notice is shorter, or where you do not attend, we may retain all or part of the deposit to cover the theatre time, staffing and materials reserved for you. Any such retention will be proportionate to the costs actually incurred.
• If we cancel or postpone your appointment for any reason, you may choose a new date or receive a full refund of amounts paid for that appointment.
• If a physician determines at any point that a procedure is no longer clinically appropriate for you, the procedure will not go ahead and amounts paid for it are refunded, less the cost of any consultation or investigation already provided.

9. Right of withdrawal for distance contracts

Under Romanian Government Emergency Ordinance no. 34/2014, consumers who conclude a contract at a distance generally have 14 days in which to withdraw. That ordinance expressly excludes health care services provided by health professionals to patients, so the statutory 14-day withdrawal right does not apply to consultations and medical treatments booked with us.

Where you purchase a product, a gift voucher or a non-medical item from us at a distance, the 14-day withdrawal right does apply, and you may exercise it by writing to contact@theroyalaesthetics.com. In every case, the cancellation terms in section 8 apply to appointments, and they are intended to be at least as favourable to you as the law requires.

10. Results and expectations

Aesthetic medicine is not an exact science. Results depend on your anatomy, skin quality, age, lifestyle, healing response and adherence to aftercare, and they vary from person to person. We commit to performing your treatment with the care, skill and diligence expected of qualified professionals — an obligation of means — but we cannot and do not guarantee a specific aesthetic outcome. Every procedure carries risks and possible complications, which will be explained to you before you consent.

11. Aftercare

Following the aftercare instructions given to you is an essential part of your result and your safety. We are not responsible for outcomes or complications arising from failure to follow those instructions, from concealed medical information, or from treatment obtained elsewhere.

12. Intellectual property

All content on the Website — text, images, before-and-after photographs, video, graphics, logos, layout and code — belongs to S.C. ROYAL AESTHETICS BY KASEM S.R.L. or its licensors and is protected under Romanian Law no. 8/1996 on copyright and related rights and applicable trade mark law. You may view and print pages for your personal, non-commercial use. Any other reproduction or use requires our prior written consent.

13. Content you submit

If you send us a review, testimonial, photograph or other material, you confirm that it is your own, that it is accurate, and that you grant us a non-exclusive, royalty-free licence to publish it in connection with our services. We may decline to publish, edit for length, or remove any submission. You may ask us to remove your testimonial at any time.

14. Links to other websites

The Website may link to third-party sites and social media platforms. We provide these links for convenience only, do not control those sites, and are not responsible for their content, products or privacy practices.

15. Availability and liability

We take reasonable care to keep the Website accurate and available, but we do not guarantee uninterrupted access, and we may suspend it for maintenance or for technical reasons without notice.

To the fullest extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the Website, from reliance on general information published on it, or from technical faults, viruses or unavailability. Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, for professional medical liability, or for any other liability that cannot lawfully be limited. Your statutory rights as a consumer are unaffected.

16. Complaints and dispute resolution

If something has gone wrong, please tell us first. Write to contact@theroyalaesthetics.com with the subject “Complaint”. We aim to acknowledge within 5 working days and to resolve the matter within 30 days.

If you are not satisfied, you may contact the National Authority for Consumer Protection (ANPC) at anpc.ro, or submit your complaint through the European Commission’s Online Dispute Resolution (ODR/SOL) platform at ec.europa.eu/consumers/odr. Complaints concerning medical practice may also be addressed to the College of Physicians of Romania (Colegiul Medicilor din România).

17. Personal data

We process personal data, including health data, as described in our Privacy Policy, and we use cookies as described in our Cookie Policy.

18. Force majeure

Neither party is liable for failure to perform caused by an event beyond its reasonable control, including natural disasters, epidemics, acts of public authority, strikes, or failures of utilities or telecommunications networks.

19. Governing law and jurisdiction

These terms are governed by Romanian law. Any dispute that cannot be resolved amicably falls within the jurisdiction of the competent Romanian courts at our registered office, without prejudice to a consumer’s right under EU law to bring proceedings in the courts of their own place of residence.

20. Severability

If any provision of these terms is held invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision is replaced by a valid one that comes closest to its original intent.
